Chapter 5: Tennessee Student Assistance Corporation

1-5-1. For purposes of this act:

• “TSAC Board” is the Board of Directors of the Tennessee Student Assistance Corporation as established by Tennessee Code Annotated section 49-4-201 et seq.

• “The TISL-TSAC Act” is Chapter 394 of the Tennessee Public Acts of 2011 and the corresponding section of the Tennessee Code Annotated, as amended.

• “Delegates at large” are delegates eligible to vote for the Governor of TISL in accordance with Article V, Section 1 of the TISL Constitution, as defined in the TISL Legal Code.

1-5-2. TISL will nominate to the Governor of Tennessee students to serve on the TSAC Board based on a vote by delegates at large during the regular annual session of the TISL General Assembly.

1-5-3. Any full-time college student in Tennessee may be a candidate for the TSAC Board, regardless of whether the student’s college participates in the TISL General Assembly.

1-5-4. As provided by The TISL-TSAC Act, TISL will nominate three students for each open seat, and the Governor of Tennessee will appoint a student to serve on the TSAC Board. Terms are for two years, begin on July 1 and are staggered such that one two-year term begins each year. One student director will be from a public college, and the other will be from a private college. For purposes of implementation, a student from a private college will be appointed to a one-year term beginning July 1, 2012. Each candidate shall be or have been a financial aid recipient at the time of his/her nomination.

1-5-5. Candidates for TSAC shall be nominated in accordance with TISL Legal Code Section 1-2-5 at the joint session of the Senate and House of Representatives at which candidates for Governor are nominated and shall be elected by delegates at large, as defined in TISL Legal Code Section 1-2-16. A prospective candidate unable to attend the General Assembly may, in lieu of being nominated, file a Notice of Candidacy not later than the close of nominations at the joint session. [TISL Bill 93, 44th General Assembly, November, 2013.]

1-5-7. Notwithstanding any other provision of law to the contrary, any student occupying or seeking an office under the TISL Constitution may also be a candidate or nominee for the TSAC Board.

1-5-8. Each voter may vote for up to three candidates in each election. The ballot will provide for write-in votes.

1-5-9. The three candidates with the most votes in each election will be nominated, regardless of any majority; there will not be a runoff election. No more than one nominee shall be from a given college.

1-5-10. Unless otherwise provided by this act, elections will be conducted in accordance with the TISL Election Procedures Act. Provided, however, the Executive Council may adopt different voting methods and longer voting hours for TSAC elections at least thirty (30) days before election day.

 

1-5-11. If any provisions of this act or its application to any person or circumstance is held invalid, the invalidity does not affect other provisions or applications of this act which can be given effect without the invalid provision or application, and to this end the provisions of this act are severable.

 

1-5-12. This act shall take effect January 1, 2012.
